Landlord-Tenant issue in upstate NY?

See if you can get an estimate on what it would cost to fill the spot- that is the amount he is able to keep- and the landlord has the right of way in this case; you may have not put it there but you "okayed" it when you first went in... He does not have the right to keep all of it just to install a new tub- again get an estimate and see what the repairs would cost-
